China’s 2026 Priority Examination Rules: Reexamination and PPH

Sources checked: 3 November 2026

When did the rules take effect?

CNIPA’s revised Measures for Priority Examination of Patents, Order No. 85, took effect on 1 September 2026. According to the implementation notice, requests filed on or after that date are handled under the new measures; requests already filed before that date remain subject to the previous measures.

Can a reexamination case qualify?

Reexamination cases concerning invention, utility model and design applications are among the categories covered by the measures. Being in a covered category does not automatically establish eligibility: the particular case, grounds, documents and other requirements must still be checked.

Where is a request filed?

CNIPA’s implementation notice states that, from 1 September 2026, parties requesting priority examination for reexamination or invalidation cases should use the Patent Affairs Service module of the patent business processing system. Requests filed from that date use the revised request form.

Is this the same as PPH?

No. Order No. 85 states that priority examination conducted under bilateral or multilateral agreements between CNIPA and other patent offices is handled under the relevant provisions rather than these measures. Assess domestic priority examination and the applicable PPH program separately; their conditions should not be conflated.
