The basic entry window
CNIPA’s guidance states that PCT national phase entry in China generally must be completed within 30 months from the priority date. If this is missed, entry may be completed within 32 months from the priority date upon payment of the applicable grace-period fee. Calculate the actual date and assess the conditions against the case records.
Documents and fees
Prepare a declaration of entry identifying the international application and the type of protection sought. An international application filed in a foreign language also requires Chinese translations of the description and claims, among other applicable documents. Check the fees and further materials against the facts and current requirements.
Filing a document alone is not the whole check
CNIPA’s process chart states that the date on which the minimum entry requirements are satisfied is the later of the document submission date and the payment date. Check both documents and payment, together with the actual official records, rather than assuming completion from a single filing screenshot.
Translation and examination
Chinese translations should accurately reflect the original application, including technical terms and relationships between components in the claims. National phase entry is one procedural stage; it is not a grant. Continue to monitor examination, official communications and applicable deadlines.
